Status

Consultations held on 7 Feb. 2001. Panel established and composed. The panel proceedings have been suspended until 1 March 2002 upon request of Brazil and the EC. The suspension has been further extended until 5 Apr. 2002. Panel proceedings resumed on 22 Apr. 2002 upon Brazil's request. Panel interim report circulated on 7 Oct. 2002.

Final report was issued to the disputing parties on 10 Dec. 2002 rejecting practically all Brazilian claims. Panel report circulated to WTO members on 7 March 2003. Brazil appealed on 23 Apr. 2003. Oral hearing held on 19 June 2003. AB report circulated on 22 July 2003. AB report and panel report were adopted on 18 Aug. 2003.

Parties mutually agreed on a 7-months reasonable period of time i.e. expiring on 19 March 2004. In implementation of the panel and AB reports findings, Council Regulation (EC) No 436/2004 of 8 March 2004 was published on 11 March 2004. The Regulation has been notified to the WTO.
