Status
EC implemented DSB recommendations (Council Regulation 1644/2001, OJ L219/1 of 14 Aug. 2001). India considers that the EC has failed to comply with the recommendations of the DSB and requested consultations under Art. 4 and 21.5 of the DSB. On 7 May India requested the establishment of a panel pursuant to Art. 21.5 of the DSU.
Panel established by the DSB on 22 May. Panel composed, report circulated on 29 Nov. 2002. It found that the EC had faithfully implemented the relevant DSB recommendations and findings. India decided to appeal to the AB certain issues in the panel report. AB hearing took place on 20 Feb. 2003. AB report circulated on 8 Apr. 2003. AB report and panel report adopted on 24 Apr. 2003.
On 20 Dec. 2003, Council Regulation (EC) No 2239/2003 was published terminating the partial interim review and the expiry review concerning the anti-dumping measures imposed by Regulation (EC) No 2398/97 on imports of cotton-type bed-linen originating, inter alia, in India.
