Target audience

All stakeholders with first-hand experience of investment screening (e.g. businesses and their associations, law firms and consultants, EU Member States’ public authorities). Contributions from other stakeholders, such as Think tanks, academic and research institutions, NGOs, civil society organisations, international organisations, governments of non-EU countries are also welcome.

Why we are consulting

Regulation (EU) 2019/452 sets out the current EU framework for the screening of foreign direct investment (FDI) into the EU. These rules aim to improve the EU’s capacity to identify and address potential risks for security or public order in more than one Member State deriving from certain transactions.

This consultation is part of the evaluation mandated by the Regulation with the aim to ensure that it remains fit for purpose in a changing global security context. Based on the outcome of the evaluation, the Commission may propose a revision of the rules while keeping the focus of the framework exclusively on security and public order.
