4th Joint EU-US stakeholders outreach event Re-export of dual-use items

Following the 3rd joint stakeholder event in November 2022, the EU and U.S. will invite stakeholders to participate to a new outreach event with a special focus on transatlantic trade facilitation in relation to dual-use item.

The EU and U.S. will invite stakeholders to participate to a new outreach event with a special focus on transatlantic trade facilitation in relation to dual-use item, in particular their re-export and relevant license requirement and exceptions.

Mindful of stakeholders’ input in the occasion of previous consultations, the event should help further fact-finding by the Export Control Working Group on the issue of identification and  streamlining of possible duplicative actions  for transactions that have obtained a license in one of the two jurisdictions, the similarities and differences between EU General Export Authorisations and US License Exceptions  and the kinds of information sharing between exporter and consignee that may be helpful.. Stakeholders’ input will feed into EU-US work to help reduce administrative burden for both economic operators and government authorities.

The EU and US co-chairs of the Export Control Working Group would like to receive your input on the following questions:

  • Are you impacted by EU or US re-export measures?
  • Do you believe that you are subject to duplicative re-export control measures? (i.e.: re-export of US item from the EU, reexport of an EU dual item from the US initially exported under Union General Export Authorisations?)
  • What are the greatest problems associated with obtaining re-export authorisations? What is the impact on your organization in terms of workload and/or time? Can you please provide specific examples?
  • Are you familiar with the relevant US license exceptions / requirements that apply to re-exports of US dual-use items from the EU to third countries? What are the biggest challenges you encounter?
  • Are the EU General Export Authorisations in EU Regulation 2021/821 and US export license exceptions in Export Administration Regulations (EAR) responding to similar needs of exporters? What recommendations would improve  the way these instruments work in the practice?
  • What types of information would be helpful to you when receiving an item under an export license or General Export EU Authorisation or US License Exception?
  • In general terms, what solutions would you recommend to the EU and US to reduce administrative burdens in the re-export of dual-use items?

The 4th Joint EU-U.S. Stakeholders Outreach event will address the above issues for the work of TTC WG7 Export Control moving forward.

This event will be opened and closed by the co-chairs and feature contributions by industry / exporters, that will be followed by an open discussion to gather feedback and ideas for future initiatives in this area. While the meeting is specifically addressed to the industry, representatives from academia and civil society are welcome to join too. The event will not be open to the press and government representatives outside EU / U.S. administrations.

Interested participants are invited to submit inputs, questions and comments in advance to the event using the Futurium online platform (EU-US Trade and Technology Council / Working Group 7 Export Controls).
