Energy Charter Treaty: Progress continues in modernisation negotiations

The European Commission and EU Member States participated in the tenth negotiation round on the modernisation of the Energy Charter Treaty (ECT) from 17-21 January.

During this round, the Modernisation Group discussed key issues such as Transit and the Definition of Economic Activity (which concerns the carve out of fossil fuels from investment protection). Another vital element that was discussed is Investment Protection and the provisions like Indirect Expropriation and the Fair and Equitable Treatment (FET).

Overall, the discussions were constructive and good progress was made, especially as regards FET and the Definition of Economic Activity.

The formal discussions will continue, included on the important topics discussed in this round, with a round of negotiations in early March. Two more formal rounds are foreseen in April and May. An ad hoc Charter Conference is scheduled to take place in June.
