The consultation will run for 12 weeks (from 4 September to 27 November) and will seek stakeholders’ feedback on the instrument’s scope, functioning and efficiency.
Article 14 of Regulation (EU) 2022/1031 establishing the IPI requires the Commission to review the scope, functioning and efficiency of the Regulation and report its findings to the European Parliament and the Council.
Given the growing barriers in non-EU procurement markets, the consultation will allow the Commission to collect evidence and views from EU producers, contracting authorities, traders, importers and other stakeholders on the IPI, in particular with regard to:
- the scope of application of IPI;
- the rules of determination of origin;
- the efficiency of the online tool designed to file a complaint on procurement market barriers in non-EU countries;
- IPI investigations and consultations with non-EU countries;
- the efficiency of the thresholds for the application of IPI measures;
- the form and scope of IPI measures;
- the implementation of obligations on successful tenderers, and;
- exceptions to IPI measures.
Experience gained from the first IPI investigation and the first IPI measure on medical devices will also be taken into consideration to evaluate how contracting authorities, contracting entities and businesses apply the IPI Regulation and the IPI measure.
Background
Regulation (EU) 2022/1031 establishing the IPI (IPI Regulation) is designed to promote market openness and ensure a level playing field for EU businesses, goods, services and works in non-EU public procurement markets. It empowers the Commission to initiate investigations against alleged restrictions in non-EU procurement markets and consult with the countries concerned to encourage market opening.
On 24 April 2024, the Commission initiated, on its own initiative, under Article 5(1) of the IPI Regulation, an investigation into alleged measures and practices of the People’s Republic of China that seriously and repeatedly restricted access of EU businesses and EU medical devices to the Chinese public procurement market. Following the publication of its investigation report and the lack of an acceptable solution from China, the Commission adopted the first measure under the IPI Regulation on 19 June 2025. The measure introduced targeted restrictions on access to the EU public procurement market for medical devices and businesses originating in China.
On 30 July 2025, the Commission published a report on the application of the IPI Regulation. The report presented the tools to support applying the Regulation, the IPI investigation into measures and practices in the public procurement market for medical devices in China, and the insights drawn from applying the Regulation.
