On 16 August 2013 the European Union (EU) requested the establishment of a panel concerning People’s Republic of China’s (China) anti-dumping duties imposed on imports of certain high-performance stainless steel seamless tubes (HP-SSST) from the EU, as set forth in Ministry of Commerce of the People's Republic of China (“MOFCOM”) Notice No. 21 [2012] (the “Preliminary Determination notice”) and Notice No. 72 [2012] (the “Final Determination notice”), including any and all annexes and any amendments thereof.

The EU challenges the dumping margins calculations, in particular the determination of a constructed normal value and a comparison between the normal value and the export price. Furthermore, the EU challenges the injury analysis as not based on objective examination of all available evidence with regard to price undercutting and injury.

The EU further challenges China’s failure to investigate or to consider other economic factors and indices. There are a number of transparency claims such as China’s failure to provide a sufficiently detailed disclosure of how it arrived to its conclusions with regard to dumping and injury.

The panel was established at the meeting of the WTO Dispute Settlement Body of 30 August 2013 and was composed on 11 September 2013. The same panel will rule on this case and the case introduced by Japan concerning the same measures (DS454).
