Summary of the case

Korea challenges the imposition by Japan of countervailing duties (CVD) on DRAMs manufactured by Hynix in Korea. This dispute is similar to DS 296 (against the imposition by the US of CVD on DRAMs from Korea) and to DS 299 (against the imposition by the EC of CVD on DRAMs from Korea)

Relevant WTO provision: Art. 1, 2, 10, 11, 12, 14, 15, 19, 21, 22 and 32 of the SCM Agreement; Art. VI:3 and X:3 of the GATT 1994

Status

The DSB established the Panel on 19 June 2006. China, the European Communities and the United States reserved their third-party rights. The Panel proceeding is ongoing.
