Final results of a full sunset review which maintains CV duties. The original duty was imposed prior to entry into force of WTO agreements. EC considers, in view of the provisions of the SCM agreement, that it would not have been possible to impose this duty of less than 1% ad valorem if the investigation had been governed by this agreement.

Status
WTO consultations held on 8 Dec. 2000. Supplementary consultations held on 21 March 2001. Panel established. Final report circulated on 3 July 2002. The panel upheld the main claim of the EC with regards to the application of the 'de minimis' rule in sunset reviews. US appealed. AB reversed the panel findings and held the US law on 'de minimis' consistent with its obligations under the WTO SCM agreement. AB and panel report adopted on 19 Dec. 2002.
